All title, ownership rights, and intellectual property rights in and to this Site are owned by Midwest Family or its licensors.  This Site contains certain licensed materials and Midwest Family’s licensors may also protect their rights in the event of any violation of these Terms.  These items include but are not limited to the following:

Product Availability

This Site is controlled, operated, and maintained by Midwest Family for the purpose of servicing our policyholders and assisting independent insurance agents with the marketing and promotion of Midwest Family products and services exclusively within the states in which we operate.  We make no representation that our products and services or the materials on this Site are suitable for or offered in every state.  Midwest Family actively writes business pursuant to state license in more than 20 states.  The full list of states and available products can be found on our website.    

Insurance Policy Terms and Conditions Control

These Terms of Use apply to your use of this Site and do not change or alter any other contract or agreement between you and Midwest Family.  Products, coverages, discounts, insurance terms, definitions, and other descriptions are intended for informational purposes only and do not in any way replace or modify the definitions and terms contained in your individual insurance contracts, policies, and/or declaration pages from Midwest Family companies, which are controlling.  All products, coverages, terms, and discounts may vary by state and certain exclusions may apply.  State law variations regarding the interpretation of insurance policies may exist.  Any statements of coverage, scope, or intent on this Site are general in nature and are subject to change based on such variations.  Your eligibility for products and services is subject to Midwest Family’s underwriting guidelines and acceptance by Midwest Family’s underwriting department. 

Secured Areas and Passwords

Some areas of this Site are restricted and require authorization for access.  Unauthorized use of or access to these areas is prohibited.  Actual or attempted unauthorized use of or access to such areas may result in criminal and/or civil prosecution.  Attempts to access such areas without authorization may be viewed, monitored and recorded and any information obtained may be given to law enforcement organizations in connection with any investigation or prosecution of possible criminal activity on this system.  If you are not an authorized user of such areas or do not consent to continued monitoring, you should not attempt to access these areas.

If you are an authorized user of any restricted area, in accessing Midwest Family sites requiring a User ID and password, you agree that:

• Midwest Family is authorized to act on instructions received under your User ID and password.
• Midwest Family is not liable for any unauthorized access to your personal information that is not the direct result of gross negligence or intentional misconduct on the part of Midwest Family. 
• You are responsible to maintain the security of your User ID and password. You will keep your User ID and password confidential and you will notify Midwest Family immediately if you suspect any unauthorized activity related to your account.  Midwest Family will not ask you for your password. 

Midwest Family will not be responsible if you do not properly secure your User ID and password or if you choose to share this information with anyone else.  In order to protect your personal information Midwest Family encourages you to change your password on a regular and frequent basis.

If you have an Insured Portal account, you may update your personal information by logging in to your account and visiting the My Account section.  If you have trouble accessing your account, please contact your agent or the Service Center at 800-CALL-Midwest Family, extension 7000.  The Service Center is available Monday – Friday, excluding holidays, from 7:00 a.m. – 7:00 p.m. Central Standard Time.  If you have forgotten your password, click on the Forgot Password link. 

Online Claims Submissions

If you are a Midwest Family policyholder, you may choose to report an insurance claim online by logging in or registering for an Insured Portal account.  Your submission does not commit Midwest Family to coverage for this loss.  Information you submit regarding your insurance policy and the loss is subject to review and verification.  Midwest Family reserves the right to request additional information in order to reach a decision on the claim.  Furthermore, this Site does not make any representations that coverage does or does not exist for any particular claim or loss, or type of claim or loss, under any policy.  Whether coverage does or does not exist for any particular claim or loss under any policy depends on the facts and circumstances involved in the claim or loss and all applicable policy wording and state regulations.  A Midwest Family claim representative will communicate with you regarding your claim.  All policy provisions contained in your policy remain in effect.  If you have any questions regarding the coverage provided by your policy, please contact your Midwest Family agent.

Limited Use

So long as you adhere to these Terms, Midwest Family grants you a nonexclusive, nontransferable, limited and revocable right to access, use, display, and navigate this Site strictly for your personal and non-public use.  You are also granted a limited and revocable license to print copies or download or install material from this Site, but solely for your personal, non-public use.  All branded or trademarked material must appear on all copies in the same manner as the original.  Except as expressly provided above, all rights are reserved.  Unless you are an independent agent associated with Midwest Family, any commercial or public use of the Site or any of its content is strictly prohibited without written permission from Midwest Family.

Independent agents are subject to the terms of their agency agreements with Midwest Family. 

Applicable Law/Severability

These Terms of Use shall be governed by and interpreted according to the laws of the State of Iowa without respect to any conflict of laws provisions.  If any portion of these Terms of Use is unlawful, void, or unenforceable, it shall not affect the validity or enforceability of any other provision.

Disclaimers of Warranties and Midwest Family Liabilities

Any information, services, materials, software, or other items on this Site are provided "as is" without any warranty of any kind, either expressed or implied, including without limitation the implied warranties of merchantability and fitness for a particular purpose. Midwest Family does not warrant that this Site will be uninterrupted or error free. Any risk arising out of use or performance of the information, services, materials, software, or other items remains entirely with you. Under no circumstances will Midwest Family be liable for any damages whatsoever arising out of the use or performance of the information, services, materials, software, or other items.

We do not warrant the content, quality, condition, accuracy, adequacy or completeness of this information.
